The U.S. Child Protection System and Courts

The U.S. Juvenile Court System and Child Protective Services

Many children in the United States are being removed from their homes on the basis of unsubstantiated reports of abuse or by obtaining relinquishments for adoption in an illegal manner. To benefit the state governments (and everyone involved) who will get federal money for it, children are ordinarily placed with strangers rather than relatives while things get sorted out. The juvenile courts in United States operate on the premise that the "best interests of the child" must come first. Judges rely on social workers and others to tell them what the best interests of the child are. Although there are no known studies on which to base their beliefs, they often claim that children will be traumatized going back to their families after a period away - even when there has been on-going visitation. The outcome of putting the so-called "best interests of the child" first often means all ties to family are cut without any proof that parents are unfit.

How Poverty Separates Parents and Children: A Challenge to Human Rights a study by ATD Fourth World - with forewards by United Nations and UNICEF, includes a description of how United States child protection system (CPS) separates family members. Discusses 1997 Adoption and Safe Families Act (ASFA) and it's contribution to the "unfair dissolution of many families"...States that "A child in the United States blames her parents for not protecting her from the child protection system."
